Underinsured Motorists Attorneys New Jersey

Injured by a Driver With No Accident Insurance?

What happens if the driver who caused your injury accident is not insured for bodily injury? What happens if the driver is insured, but his or her policy doesn't cover all of your damages?

Most auto insurance policies have uninsured motorist/underinsured motorist (UM/UIM) coverage for this scenario. However, insurance companies often fight these claims even when policy holders have serious injuries. Personal injury attorney Jae E. Lee and the legal team at Fishman McIntyre P.C. will stand up for your rights when you most need your insurance provider to honor its obligations.

Uninsured Motorist/Underinsured Motorist (UM/UIM)

The Insurance Research Council estimates that at least 8 percent of New Jersey drivers do not carry the state-mandated liability insurance. However, your injuries and losses should still be covered through an uninsured motorist claim under your policy if the other driver had no insurance. Uninsured motorist also covers you for phantom vehicle accidents (unidentified hit-and-run) and if the negligent motorist or the insurer is bankrupt.

Many drivers who do have liability insurance carry only the minimum coverage of $15,000 per victim, up to a maximum of $30,000 total for an accident. If there were several people injured, or if the injuries are severe, that driver's insurance may not cover all the losses. Your underinsured motorist policy should cover the rest.
